A CONVERGÊNCIA ENTRE “DIREITO E DESENVOLVIMENTO” E GOVERNANÇA GLOBAL

Nas últimas duas décadas as teorias institucionais passaram a dominar os Estudos de Desenvolvimento. Os expoentes dessas teorias reconhecem que o desenvolvimento socioeconômico de um país depende, em menor ou maior medida, da existência de níveis mínimos de infraestrutura física, de capital financeiro e humano, e/ou de fatores geopolíticos, geográficos, históricos e culturais. Institucionalistas argumentam de forma convincente, no entanto, que investir na construção de um sólido arcabouço institucional no âmbito nacional é o modo mais eficaz – talvez até um pré-requisito – para se promover o desenvolvimento de um país3. Esse arcabouço de "boa governança", de acordo com teóricos institucionalistas, seria a peça chave para facilitar e/ou garantir a concretização das diversas estratégias desejadas de desenvolvimento na área de infraestrutura, modernização econômica e cultural, etc. Esse arcabouço institucional também seria essencial para lidar com as diversas externalidades negativas e as desestruturações socioeconômicas que são também inerentes ao processo de desenvolvimento.
