Professor Robert Alexy's theory of fundamental rights is recognized worldwide as a milestone in fundamental rights dogmatics. Especially in Brazil, this theory has been taken up and studied by the legal community, mostly lacking a critical approach. In this sense, this essay aims to offer the reader an argumentative approach that presents a critical approach to the theory of Robert Alexy. In doing so, the paper fulfills its main objective: to present theoretical alternatives for approaching the theory of principles and to provide the reader alternative paths for a wider debate on the theory of fundamental rights. The research had as its main bibliographic reference the works and articles of both authors, which are mentioned throughout the text. In this way, the reader can make a first contact with the main ideas of Alexy's theory of principles and compare them with the criticism presented by Poscher.
