Abstract

The purpose of this article is to identify what we call the social paradigm of risk: a sociological basis for understanding the contemporary risks and build a bridge to their theoretical assimilation within the theory of state and constitutional law. Risk has become a key element for the understanding of Constitutional Law, but Law itself does not provide a meaning for risk in contemporary society. Social sciences, on the other hand, have developed various possible frameworks dealing with risk, which, nonetheless, may conflict with each other. Rather than focusing on the differences that create points of conflict between the various theoretical frameworks of risk, this work focus on mapping the consensus points of the approaches developed in the social sciences. In this light, the absence of a homogeneous approach can be seen as an advantage, living up to the multidimensional nature of risk in modern society.

Professor Universitário - Universidade Vila Velha (UVV-ES) - Programa de Pós-Graduação em Sociologia Política e Faculdade de Direito. Doutor em Direito Constitucional e Teoria do Estado pela PUC-Rio. É Mestre em Direito Público pela UERJ e Bacharel em Direito pela UFBA. Cursou especialização na American University, Washington College of Law. Foi bolsista da Comissão Fulbright e do Departamento de Estado dos EUA (H. Humphrey Fellowship Program). É Juiz Federal na 2a Região (RJ e ES).
