EMERGENCY MEASURES AND PUBLIC HEALTH IN CRISIS
HOW HAVE THE LAWS OF MUNICIPALITY OF RECIFE ON THE USE OF FACIAL MASKS BEEN CHANGED THROUGHOUT COVID-19’S PUBLIC CALAMITY?

How have the laws of Municipality of Recife on the use of facial masks been changed throughout COVID-19’s Public Calamity? The literature on decision-making in matters of federal conflicts in the time of sanitary crisis points to a behavioral patter, in which the Supremo Court has, over the last years, affirmed the protagonism of Governos and Mayors in facing in matters of public health, to the detrimento of the interests of other federative entities (the Union and Federal District). How has this situation of epidemiological camalamity affected the decision-making’ strategies of the Municipality of Recife regarding the facing Coronavirus? This article is dedicated to the qualitative analysis of the collegiate decision ADPF 672 MC-REF/DF, through a case study, with the purpose of understanding how such exceptional circunstances of sanitary calamity influenced the use of facial masks’s strategy in that municipality and the court’s decision-making process on federal conflitcs. It was concluded that such exceptional circunstance influenced the legislative trajectory of municipal government throughout such sanitary calamity and, regarding the use of facial mask, there is na inconsistency between the strategy applied by the municipality, the State of Pernambuco, and the Union.
