This paper relates to the field of study of Legal Philosophy. The proposal conveyed by this piece is to conduct an analysis, both political and philosophical, of the Supreme Court’s procedure in order to outline the true nature of this institution. By the analysis of the votes and arguments listed in the ADPF 186 one may extract three points of inquiry. The first deals with the mysticism involving the Federal Constitution of 1988, conceived as the ultimate defender of fundamental rights. The second points to the decision techniques used by our Supreme Court, consistent in an abusive use of principles as arguments of authority. The third consists in the analysis of the position held by the Court on the separation of powers. As a result, we have that the Supreme Court, despite the idealism that surrounds it, is an active agent in the political scenario.
